Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and DailyYardSales.com (“we,” “us,” or “our”) governing your access to and use of the DailyYardSales.com website, mobile applications, and related services (collectively, the “Service”).

By creating an account, posting a listing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

To use DailyYardSales.com, you must:

• Be at least 18 years of age (or 13 with verified parental consent for browsing only)
• Be a resident of the United States or its territories
• Have the legal capacity to enter into a binding contract
• Not have been previously suspended or banned from the Service
• Provide accurate, current, and complete registration information

Sellers must additionally have the legal right to sell the items listed. You may not use the Service on behalf of any person or entity without their express written authorization.

When you create an account, you are responsible for maintaining the security of your credentials and for all activity that occurs under your account. You must:

• Choose a strong, unique password and keep it confidential
• Notify us immediately at hello@dailyyardsales.com if you suspect unauthorized access
• Ensure your account information remains accurate and up to date
• Not share your account with others or create accounts for third parties without authorization
• Not create multiple accounts to circumvent bans or listing limits

We reserve the right to disable or terminate accounts that violate these Terms, show signs of fraudulent activity, or have been inactive for more than 24 consecutive months.

DailyYardSales.com is a classifieds platform for Madison and Jefferson County, Indiana. It carries four kinds of listing: sales (yard, garage, estate, moving, tag and rummage), vehicles offered by private sellers and dealers, property to let, and job vacancies. All listings must comply with the following rules:

The following content is strictly prohibited on DailyYardSales.com. Violations may result in immediate account termination and reporting to law enforcement:

Featuring a listing is a one-time purchase (“$2.99” or the price shown at time of purchase) that pins the listing to the top of relevant results and adds a highlighted badge. By purchasing, you agree to the following:

• This is a one-time charge, not a subscription — nothing renews automatically
• Featured placement lasts for the duration shown at checkout
• A featured listing must still comply with these Terms; a removed listing is not refunded
• We reserve the right to change pricing at any time, with existing purchases honoured

Payments are processed through Stripe. We do not store your payment card information. See Section 7 for refund policy.

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees.

Our content: DailyYardSales.com, its logo, design, software, AI features, and original content are owned by or licensed to us and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Your content: You retain ownership of all content you post (listings, photos, descriptions). By posting content, you grant DailyYardSales.com a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute that content on the platform and in promotional materials. This license ends when you delete your content.

DMCA: If you believe content on our platform infringes your copyright, please send a DMCA takedown notice to legal@dailyyardsales.com with: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, and (4) a statement of good faith belief.

To the maximum extent permitted by applicable law, DailyYardSales.com and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data, or goodwill; personal injury; or property damage arising from your use of the Service.

Our total liability to you for any claims arising from use of the Service shall not exceed the greater of (a) $100 or (b) the total amount you paid to DailyYardSales.com in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above may not apply to you in full.

You agree to indemnify, defend, and hold harmless DailyYardSales.com and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you post, list, or transmit through the Service
• Any transaction or interaction with other users

By you: You may delete your account at any time from your profile settings. Upon deletion, your listings are removed within 24 hours and your data is handled per our data retention policy.

By us: We may suspend or terminate your account immediately, without notice, if we determine you have violated these Terms, engaged in fraudulent activity, or if required by law. We will provide notice where reasonably practicable.

Upon termination, your right to use the Service ceases immediately. Featured listing fees already paid are non-refundable except as provided in Section 7. Sections 8 (IP), 9, 10, 11, and 13 survive termination.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Informal Resolution: Before filing any legal claim, you agree to first attempt to resolve the dispute informally by contacting us at legal@dailyyardsales.com. We will attempt to resolve the dispute within 30 days.

Arbitration: If informal resolution fails, any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English, and the award shall be final and binding.

Class Action Waiver: You agree to resolve disputes only on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

We may modify these Terms at any time. When we do, we will update the “Last updated” date above and notify registered users by email at least 14 days before changes take effect for material changes. For minor changes, the updated date is sufficient notice.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.
